This is our Privacy Policy ("Policy") which is applicable to the processing of personal data that we carry out at BYHOURS through our Website and App(s). This Policy is an integral part of our User Agreement.

Applicable regulations and principles of Personal Data Protection

The collection of personal data, its processing and subsequent use by BYHOURS is subject to EU Regulation 2016/671 General Data Protection Regulation, dated April 27, 2016 (hereinafter, by its acronym in English, GDPR), and to Spanish regulations that develop the GDPR from its date of application on May 25, 2018;

At BYHOURS we process our Users' personal data in accordance with the following principles (established in said regulations):

  • Process user data lawfully, fairly and transparently.
  • Process data limited to the purpose for which it was collected.
  • Data minimization: Process adequate, relevant and limited data to what is necessary.
  • Accuracy: Process accurate data and, when necessary, updated.
  • Limitation of retention period (no longer than necessary for the purposes).
  • Integrity and confidentiality (ensuring an adequate level of security).

What personal data does BYHOURS collect from Users?

At BYHOURS we collect the data necessary to guarantee and enable access, use and/or contracting of our hourly hotel reservation services, and to keep you informed of offers and promotions. In this way, to register, we only collect your email address and the password you have chosen.

To use our reservation services we may collect (if you communicate it to us in your user area), -among other data- your first and last name, title, your email address, the city where you reside, a contact phone number and, where applicable, the data necessary to manage payment for services. We also store your reservation information so that you can know your reservation history and control and manage your past and future reservations.

BYHOURS will not process personal data of minors, as minors are not allowed to use our services, as indicated in our User Agreement.

At BYHOURS we only collect and process personal data when:

  • We have your consent, or
  • when it is necessary to provide you with our services based on compliance with our contracts, or
  • In case we must comply with our legal obligations

Therefore, we collect the data that you voluntarily provide us when filling out the forms on our Website and/or Application that we make available to you according to how you identify yourself at each moment, in accordance with our User Agreement.

What do we use your personal data for?

BYHOURS only uses your personal data for the following purposes:

  • to provide you with the BYHOURS services you have requested, including managing the reservation of the hotel chosen for the selected hours;
  • attend to your requests or questions, manage all communications and provide you with all the information you request;
  • keep you informed about our services and exclusive promotions for registered users according to the conditions of the User Agreement.
  • to obtain behavioral patterns, as well as carry out statistics to know the traffic and use of our Website, APP or other platforms, to determine your tastes and preferences and be able to send you promotional information or advertising of our own services, according to your interests.

What if you register with your social networks?

Registration with Facebook or Google will only serve to complete the registration form. Therefore, if you register using Facebook or Google, BYHOURS will only process the data necessary for registration, guaranteeing that we will not use or store more data from your social networks.

Who do we share your personal data with?

In order to offer you our services, in accordance with the purposes indicated above, BYHOURS will share your personal data with:

  • Hotels and establishments, for the purpose of managing the reservation you have requested, being necessary to execute and manage the reservation contract.
  • With our providers, in order to ensure the best service, guaranteeing adequate security for your personal data:
    • We use the services of Ve Global Iberia S.L. (calle Ayala 27, 6º izquierda, 28001 Madrid, hereinafter 'Ve'). To provide its services, Ve uses cookies and other similar technologies that collect personally identifiable information from end users who visit our website. For more information about the technologies that Ve uses, see Ve's Cookie Policy - a list of the purposes for which Ve collects personal information is found therein. Through the use of cookies, Ve collects personal information from end users, especially contact information and behavioral data. Ve uses this information to draw conclusions about end user preferences and to personalize the web experience, for example, showing customized offers or similarly personalizing the website for the end user and showing ads when visiting client websites or third-party websites. Ve and we are joint controllers of personal data collection in accordance with Art. 26 GDPR. Details can be found in Ve's Privacy Policy.
    • End users can prevent the processing of their personal data by Ve through various means. The options available to prevent data processing are found in Ve's Privacy Policy, among others, activating the opt-out button at https://www.ve.com/es/politica-de-privacidad#opting-out or using the IAB Europe opt-out mechanism at http://www.youronlinechoices.com/opt-out-interface.

What rights do you have regarding privacy and how to exercise them?

As a BYHOURS User you can exercise your privacy rights at any time and free of charge as established by applicable regulations, such as:

  • know what personal data of the User has been collected and processed by BYHOURS, for what purposes and with what third-party recipients such data is shared;
  • obtain a copy of such data (the second and subsequent copies may generate administrative costs);
  • request rectification of inaccurate personal data concerning you, or to complete those that are incomplete;
  • request deletion of personal data concerning you when they are no longer necessary in relation to the purposes for which they were collected;
  • request limitation of processing of personal data relating to the User, while their potential inaccuracy and other assumptions provided for in applicable regulations are verified;
  • the right to have your personal data transmitted to another company in a common structured format (right to data portability); or
  • the right to object to such processing of your personal data by BYHOURS.
  • you also have the right to file a complaint with a competent control authority (https://www.aepd.es/).

How to request deletion of your data?

BYHOURS users can request at any time the deletion of their account and associated personal data. You have two ways available:

  • From the user area: access your profile within the Website or App and use the "Delete account" button, with which you can unsubscribe your profile and delete the associated personal information.
  • By email: you can also send us a data deletion request by writing to privacy@byhours.com, indicating in the subject "Personal data deletion" and the email address associated with your account.

Once your request is received, we will delete your data permanently within the deadlines provided for by applicable regulations, unless we must retain them for a longer period to comply with legal obligations.

How long do we keep your personal data?

Your data will be retained until the time of your definitive cancellation as a BYHOURS user as well as the time necessary to comply with our legal obligations. If you are not a registered user, we retain the data for the time necessary to manage the reservation contract, as well as to keep you informed, as well as to comply with our applicable legal obligations.

Commitment to data veracity

We remind you that each user is responsible for the information provided and is responsible for its adequacy and veracity. Therefore, BYHOURS will not be responsible for data that is not true, adequate and/or truthful.

Changes to the Privacy Policy BYHOURS reserves the right to modify its privacy policy at any time. In any case, BYHOURS will always reflect all changes transparently and visibly in this privacy policy.
